Florida DBPR Orders Bars to Suspend Sale of Alcohol for Consumption on Premises

On June 26, 2020, the Florida Department of Business and Professional Regulation issued Emergency Order 2020-09, which orders “vendors who derive more than 50% of gross revenue” from on-premises alcohol sales to suspend the sale of alcoholic beverages for on-premises consumption. The Order went into effect immediately statewide. The Order also provides that “such vendors may continue to sell alcoholic beverages in sealed containers for consumption off the premises.”

The Order does not apply to restaurants, which may continue to sell alcohol for consumption on-premises, “so long as these vendors derive 50% or less of gross revenue from the sale of alcoholic beverages for on-premises consumption.”

The Order was issued shortly after the State of Florida reported nearly 9,000 new COVID-19 cases—the largest single-day jump since the start of the pandemic.
