Representative Client Experience
- As an Assistant State Attorney, tried over 65 cases to verdict ranging from petit theft and DUI to armed robbery and felony murder resulting in substantial jury trial experience.
- Successfully defended Developer over a two-week jury trial with 4000 exhibits in a construction delay case involving 450 apartment units.
- Successfully represented at trial various lienors including Contractors and Design Professionals seeking to enforce their contractual rights to receive payment for services, material and labor provided.
- Achieved a $1,500,000.00 settlement for a Developer in a lawsuit seeking recovery from multiple parties for construction and design defects resulting in water intrusion at an apartment project.
- Obtained a $1,000,000.00 settlement for a developer on a vigorously contested claim for professional negligence brought against an environmental engineering company arising out of the development of a former shooting range site contaminated with arsenic and lead in the soil and groundwater.
- Drafted and negotiated Development Agreement and related Developer-Contractor and Developer-Architect Agreements for the design and construction of a 1500 room hotel and convention project with contracts totaling over $420,000,000.00.
- Drafted and negotiated AIA and proprietary Owner-Contractor and Owner-Design Professional Agreements with cumulative contract values well in excess of $1,000,000,000.00.
- Drafted and negotiated a $41,000,000.00 design-build agreement for the design and construction of a 235,000 sq. ft. LEED Silver manufacturing plant. The project was funded in part by federal stimulus monies payable by the Department of Energy pursuant to the American Recovery and Reinvestment Act legislation. Additionally, the local municipality pledged a portion of the project funding which was tied to job creation within set time periods.
